Ignasiak (affectionately called Doctor Bob by the locals of Freeport) has been wrongly convicted by the United States Federal Government of prescribing controlled substances to patients without determining a sufficient medical necessity. What business does the governement have telling a doctor how to treat his patients? Together with Teresa, they started a “Mom and Pop operation”. The Freeport population at the time was a small 500 people within the town limits and Dr. Bob was the only full-time doctor. As the small town of Freeports, Floridas first and only doctor, Dr. Bob has cared for thousands of patients and has always prescribed dosages that adhered to the Physicians Desk Reference. He founded the Freeport Medical Clinic in 1985 has served the local community for more than two decades./p>p>As one former employee who worked at the clinic affirmed during the trial, “if somebody was sick in Freeport and needed to see a doctor that particular day, they would come to see Dr. Ignasiak.” In 2005, after making successfully returns on investments made in real estate, Bob decided to retire./p>>div classdot>/div>/li> li data-year2005 data-titleFirst victory data-contentp>In Spring of 2005, Dr. Ignasiak was audited by Dr. Timothy Walker from Medicaid, claiming that Dr. Ignasiak intermediate visits were too short in time to qualify as intermediate despite Dr. Ignasiak detailed notes outlining each patient visit. Dr. Ignasiak hired a lawyer that argued his sessions met the necessary criteria and won the case./p>p>Dr. Walker then submitted Dr. Ignasiak name to the DEA after noting several patients received controlled substances for chronic and painful conditions. In the last month of 2005, Dr. Ignasiak decided to retire./p>>div classdot>/div>/li> li data-year2006 data-titleDEAs first strike data-contentp>The DEA raids Dr. Ignasiak office and confiscated all of the medical charts - calling them evidence./p>>div classdot>/div>/li> li data-year2008 data-titleArrest and Trial data-contentp>span classsubheading>February/span>Dr. Ignasiak was arrested for 54 counts centered around the charge that Dr. Ignasiak had prescribed unnecessary quantities of controlled substances to 20 former patients between May 2003 and December 2005 without a legitimate medical “purpose” and “outside the usual course of professional practice”./p>p>span classsubheading>October/span>Judge Collier rejects pretrial motions. During the trial, the prosecution used an expert witness to claim that Dr. Ignasiak violated the standard of care. The prosecution focused on presenting the number of prescriptions for controlled substances as abnormally high, despite prescribing only ⅓ of the maximum number (150) of controlled substances per day dictated by The Florida Board of Medicines Rule #64B8-9.0134. Only one of the Dr. Ignasiaks patients in the indictment testified. She admitted she had exaggerated her complaints of pain while on the stand./p>>div classdot>/div>/li> li classhidden data-year2008 Continued data-titleTrial Continues data-contentp>span classsubheading>October/span>The defense called upon two witnesses: Dr. Leonard Rappa (Pharm.D) and Dr. David Fowler (M.D.)/p>p>span classspacer>/span>Dr. Rappa documented that the combinations of medicines that Dr. Ignasiak prescribed were not excessive, either individually or in combination, and were appropriate for the conditions documented in the medical records from a pharmaceutical standpoint./p>p>Dr. David Fowler was the Chief Medical Examiner for the state of Maryland. He documented that, due to redistribution, toxicology reports on drug levels in the body after death are misleading. He reviewed the autopsy reports of what the prosecution presented and declared that the deaths were either “natural”, the result of suicides, or uncertain. /p>>div classdot>/div>/li> li classhidden data-year2008 Continued data-titleThe Verdict data-contentp>span classsubheading>October/span>Dr. Ignasiak was convicted on 43 counts for 15 patients and acquitted on 11 counts for the other 5 patients. He received a sentence of 25 years!/p>>div classdot>/div>/li> li data-year2009 data-titleThe Appeal data-contentp>The defense submits an appeal for mistrial in hopes that a higher court will be correct this injustice and Docotor Ignasiaks wrongful imprisonment./p>>div classdot>/div>/li> li data-year2012 data-titlePartial Justice data-contentp>span classsubheading>May/span>Dr. Ignasiak partially wins his appeal and is released from jail. The appeals court overturns all the convictions in the first two arguments but does not acquit Dr. Ignasiak of all of his counts.span classspacer>/span>The court remands the case back to the District Court (Judge Lacey A. Collier, the same judge that presided over the original trial) for further proceedings./p>p> span classspacer>/span>span classspacer>/span>span classspacer>/span>With the same judge and a similar jury, the retrial was likely to have the same outcome. Judge Collier, the same judge, denies it./p>p>span classsubheading>November/span>Dr. Ignasiak falls into despair at the hopelessness of getting a fair trial and fakes his own death.
